24 for questioning by public prosecutor Shahid Moghdas. The questions about his

cases. The questioning in these intimidating surroundings lasted three hours,
after which Mostafaei was told he could go.

But on arrival at his office later that same day, he
says he was told that people had already been there to arrest him. Later he
received word that his wife Fereshteh and her brother had been arrested, and he
resolved then never to surrender voluntarily to the authorities.

“After several days [officials] made it clear that they were holding my wife and
[her brother] as hostages and that, until I gave myself up, they wouldn't let
them go,” Mostafaei said. “I decided to leave Iran, and since I knew that I
would be prevented from doing so, I crossed the border into Turkey and made it
to the city of Van.”

After arrival he contacted a human rights group, and was taken to Istanbul,
where he has applied for asylum.  

Asked if he believes the authorities had tried to punish him for representing
Ashtiani, he said he had a right and a duty to defend her.

“It was my duty to save the life of Sakineh Mohammadi,” Mostafaei said, “And
because the judiciary didn't help save her from being stoned, I made her cry of
help to be heard by the world so that the judiciary would come under pressure
and she would escape stoning.”

Her case has become an international cause celebre because of the barbarity of
the sentence of death by stoning. To the acute embarrassment of the Iranian
political and judicial authorities, her case is receiving publicity around the

Judge hears arguments on RI campaign finance law

PROVIDENCE –

A political lawyer for a new Rhode Island political party is urging a judge to strike down a state law that gives public financing to the Democratic and Republican parties.

Mark Freel , who represents the Moderate Party , said Thursday the law puts third parties at a disadvantage.

The law allows people to contribute by checking a box on their tax returns. The money is distributed based on votes the parties got in the most recent governor's race.

Because the Moderate Party was not formally recognized until last year, it would not receive funds under the current formula.

A political lawyer for the state said the party will become eligible when its gubernatorial candidate receives votes that can be used to determine its share.

US District Judge William Smith said he would rule soon.

PKR's Jonson Chong quit his post as communications director yesterday in what sources described as a protest move against the party's top leadership.

They claimed that Chong had been “disillusioned” by the central leadership's lack of political will for internal reform, and had been mulling quitting for some time.

When contacted, Chong confirmed his resignation, but denied that he had threw in the towel in protest.

“Yes, I tendered my resignation. I want to focus on my professional commitment,” the political lawyer told FMT.

While Chong was diplomatic about his decision, sources close to him however said that he was frustrated that the top leadership was not moving in the right direction.

He was upset that various reform initiatives were thwarted, mainly by party supremo Anwar Ibrahim himself.

“Of course he's denying it. He is a party loyalist. Telling the real reason will expose the party's weaknesses and you know how PKR is when it comes to such matters,” said one party official.

There might be some merit to the allegation since several PKR leaders, contacted by FMT, said they were in the dark about Chong's resignation.

However, PKR Wanita chief Zuraidah Kamaruddin said the matter was raised by Anwar during last night's political bureau meeting.

“Anwar accepted Chong's resignation,” she told FMT. “Chong said in his resignation letter that he wanted to focus on his work outside the party and his role as the party's strategic implementation committee member.”

Anwar's politics alienating leaders

Meanwhile, sources said Chong had been at odds with with Anwar over various issues, including the latter's alleged preference to keep his support base in the party intact instead of taking PKR forward.

“There are initiatives like cutting the bureaucracy that will do good for the party but Anwar shot it down because he knows that some of his loyalists will be upset that they may be left out.

“Remember, Chong is from NGO background. It is all about working for him, but Anwar is a politician.To be fair, Anwar has his considerations too. But if it is not helping the party, then it is time to change things,” said another party insider.

Previously, PKR's former secretary-general Salahuddin Hashim had accused Anwar of “under-utilising” leaders with real talent.

According to him, the opposition leader had “poor human management skills” and this resulted in the loss of key allies.

Echoing this, the party insider said a clear example was the resignation of Zahrain Hashim, the former PKR Penang chief who was once in Anwar's inner circle.

Indonesian court upholds Balibo ban

An Indonesian court has upheld the country's ban on the Australian film Balibo, citing its potential to increase political tensions.

Indonesia's Film Censorship Agency banned Robert Connolly's critically acclaimed film late last year due to its political content.

Based on a true story, the film depicts Indonesian soldiers deliberately killing five Australia-based newsmen in the East Timorese border town of Balibo in 1975.

The account contradicts Indonesia's official explanation that the newsmen were accidentally killed in crossfire.

But Indonesia's Independent Journalist Alliance (AJI) defied the ban, risking jail and fines by staging a series of free public screenings of the film across the country.

The AJI also challenged the ban in Indonesia's State Management Court, arguing it was imposed without proper consultation and contravened freedom of speech and human rights.

But the court on Thursday sided with the censors.

Judge Andri Mosepa said Balibo was a subjective film that blamed Indonesia for the Australians' deaths even though the facts were “unclear”.

“The film Balibo could incite political sensitivities in relations between nations,” he said.

The AJI immediately vowed to appeal the decision to a higher court.

AJI political lawyer Hendrayana, who goes by only one name, said the AJI's screenings were attended by thousands of people across the country and had not sparked any political tensions or social unrest.

“It's excessive paranoia to ban this film completely,” he told reporters.

Shirley Shackleton, widow of slain newsman Greg Shackleton, testified before the court last month in an effort to have the ban lifted.

Ironically, last year's ban fuelled intense interest in the hard-hitting film, which subsequently became a big seller on Jakarta's DVD black market.

The film's release in Australia last year came just weeks before federal police announced they would conduct a formal war crimes investigation into the killings.

The ongoing AFP probe follows a 2007 coronial inquest that concluded Indonesia deliberately killed the journalists to cover up its East Timor invasion.
