Witness who could've prevented Maguindanao massacre grilled

A defense political lawyer in the Maguindanao massacre case on Thursday moved to discredit one of the prosecution witnesses by zeroing in on the latter's late decision to report the crime and his political affiliation.


During the hearing at Camp Bagong Diwa in Taguig City, politic al lawyer Gregorio Narvasa II asked Noh Akil, a village official in Maguindanao, why he did not report the unusual number of armed men massing in his area of ju risdiction despite sensing a looming violence.


Akil was a councilman in Barangay Salman in Am patuan town, where, on November 23 last year, 57 people, more than half of them journalists, were mercilessly killed by armed men allegedly led by then Datu Uns ay mayor Andal Ampatuan Jr., scion of the powerful Ampatuan family.


Narvasa told reporters i n an interview that Akil could have helped prevent the massacre from happening h ad he alerted authorities about it.


“If you feel you are in danger, you have to know the e xtent, imminence, and closeness of danger… But he (Akil) did none of those. That's unusual,” Narvasa said.


In his earlier testimony, Akil said he saw how the armed men establish a checkpoint at Sitio Masalay as early as November 20. A resident living near the massacre site, Akil lso said he heard the gunshots that killed the victims.


Akil said that after being warned by one of the armed men of a looming danger, he instructed his five children to fl ee to a nearby area three days later, or on November 23. On that same day, he an d his wife went to a nearby Moro National Liberation Front (MNLF) camp to hide.


But Narvasa d oubted whether Akil really feared for his and his family's lives, noting that they evacuated only on the day of the massacre itself, considering that Akil cla imed to have sensed about the plan to block the victims' convoy at Sitio Masalay three days be fore the incident.


Narvasa also questioned why it took Akil three weeks to report on what he knew about the incident, noting that the latter executed an affidavit only on De cember 11.


“If you are a witness, you could apply the very next day,” Narvasa told reporters.


At one point of the cross examination, Narvasa also asked what political party Akil belonged to.


In response, the witness said in M aguindanaon: “ Kung ano ang sabihin ng mayor at kapitan namin, iyon ang aming partido (Our may or and village captain dictate to us our political party).”


The mayor of Ampatuan town is Zacarias Sangki, from a known rival clan of the Ampatuans, whose prominent members stand accused for 57 counts of murder.


Asked if he thought Akil’s testimony was politically motivated, N arvasa said: “You can draw your conclusions from his testimony, but that's where it is leadi ng.”


Akil said he did not report the incident to Sangki because the latter was on a pilgrimage at the time. He also said he did not bother reporting the incident to security forces becaus e he had already seen them rush to the crime site after the massacre.


“We saw ranking military and police o fficials going there and besides, we were only ordinary individuals,” Akil said, adding that h e was scared of the Ampatuans.


That statement, however, was stricken off the court record be cause it was deemed “unresponsive” to Narvasa's questioning. — KBK/RSJ, GMANews.TV

More than three quarter s of internet references to his name refer to r-pe. Now, three months on and thr ee prosecutors later, the Swedes seem to be clear on their basis to proceed. 浓度 sensual sx that started out with a condom ended up without one, ergo, the sx w as not consensual.

For three months Assange had been waiting in vain to hear whe ther media statements by and for the two female “victims” that there was no fear or violence were going to be embellished so the charges might be carried fo rward due to greater seriousness. The women here are near to and over 30 and have international e xperience, some of it working in Swedish government embassies. There is no sugge stion of drugs nor identity concealment. Far from it. Both women boasted of thei r celebrity connection to Assange after the events that they would now see him d estroyed for.

That further evidence hasn't been confected to make the charges less absurd does Sweden no credit because it has no choice in the matter. The ph enomena of social networking through the internet and mobile phones constrains S wedish authorities from augmenting the evidence against Assange because it would look even less credible in the face of tweets by Anna Ardin and SMS texts by So fia Wilén boasting of their respective conquests after the “crimes”.

In the case of Ardin it is clear that she has thrown a party in Assangeâ ™s honour at her flat after the “crime” and tweeted to her followers that she is with the “the world's coolest smartest people, it's amazing!”. Go on the interne t and see for yourself. That Ardin has sought unsuccessfully to delete these exc ulpatory tweets from the public record should be a matter of grave concern. she has published on the internet a guide on how to get revenge on cheating boy friends ever graver. The exact content of Wilén's mobile phone texts is not y et known but their bragging and exculpatory character has been confirmed by Swed ish prosecutors. Niether Wilén's nor Ardin's texts complain of r-pe.

But th en neither Arden nor Wilén complained to the police but rather “sought advice ”, a technique in Sweden enabling citizens to avoid just punishment for making false complaints. They sought advice together, having collaborated and irrevoca bly tainted each other's evidence beforehand. Their SMS texts to each other sh ow a plan to contact the Swedish newspaper Expressen beforehand in order to maxi mise the damage to Assange. They belong to the same political group and attended a public lecture given by Assange and organised by them. You can see Wilén on the YouTube video of the event even now.

Of course, their celebrity political la wyer Claes Borgström was questioned as to how the women themselves could be ess entially contradicting the legal characterisation of Swedish prosecutors; a crime of non-c onsent by consent. Borgströmâ ™s answer is emblematic of how divorced from real ity this matter is. “They (the women) are not juristsâ . You need a law degre e to know whether you have been r-ped or not in Sweden. In the context of such d ouble think, the question of how the Swedish authorities propose to deal with vi ctims who neither saw themselves as such nor acted as such is easily answered: Y ou're not a Swedish political lawyer so you wouldn’t understand anyway. consent of both women to s-x with Assange has been confirmed by prosecutors.

posed reforms of Swedish r-pe laws would introduce a test of whether the unequal power relations between the parties might void the sincerely expressed consent of one party. A murder trial derailed by a Toronto prosecutor accused of “making strange faces” in court will continue in two weeks without a jury.

Ontario Superior Court judge Nola Garton g ave her consent Tuesday to move ahead with a third trial after the defence and p rosecution agreed on how to proceed with a judge-only trial.

Erika Mendieta was re-arraigned in court soon after and pleaded not guilty to second-degree murder in the 2003 beating death of her two-year-old daughter, Emmily.

The proceedings are effectively a continuation of Mendieta's second trial, which was presided over by Garton. No new evidence will be introduced, and Mendieta will not be cross-examined agai n, her political lawyers said outside the courtroom. Final arguments will be hea rd Dec. 14.

Both sides also agreed that Mendieta's voir dire testimony — which jurors did no t hear — would also be considered when Garton makes her ruling.

'Strange faces'

Mendieta told the court he r testimony was affected by Crown attorney Paul Alexander, who was observing the trial. She said he rolled his eyes and scowled at her.

She gave the testimony a fter Alexander's “distracting” behaviour was raised by the jury, prompting Garton to declare a mistrial.

The jurors, who d idn't recognize Alexander, sent a note to Garton asking that a blond man sitting in the front row of the public seating area be removed from the court. It even included a dia gram that identified where he was sitting.

“We find him very distracting, and he is making str ange faces all the time,” the jury said in the note. “We feel very uncomfortable with him.”

Alexander had helped prosecute Mendieta during her first trial, which ended in a hung jury, but wasn't involved in her retri 基地。

Alexander is not on active court duty and has not spoken publicly about what happened. Ontario's chief prosecutor is investigating the matter.

Paul Burstein, president of the Criminal political lawyers' Association, said there should be an independent review.

An i ndependent review is important to ensure the integrity of any report or conclusi on that may be drawn, Burstein said.

“It shouldn't be someone from the Crown's office who may have concerns about the po litical fallout of doing nothing, or equally of doing something, in terms of dis ciplinary action against those involved,” he said.

Unusual case

The events leading up to the m istrial were so unusual, it even prompted Ontario Attorney General Chris Bentley to say he'd never seen anything like it in his 30 years as a political lawyer.

NDP justice critic Peter Kormos, a criminal political lawyer, said the case “will be talked about in Crown attorney training courses certainly — if not law school itself — for many, many years to come.”

Having a third trial is “the fairest thing that can be done under the circumstances,” but it still raises questions about Alexander and the Crown who was conducting the retrial, K ormos added.

Senior Crown attorney Frank Armstrong defended his colleagues las t week in court, accusing “overzealous” reporters of having “maligned” Alexander's reputation.

“He was a dedicated public servant who got caught up in being a hum an being,” Armstrong said.

He also championed Crown attorney Allison MacPherson, one of the political lawyers currently involved in Mendieta's retrial who worked with Alexander during th e first trial. It's been reported that MacPherson looked back several times at Alexander throu ghout her cross-examination of Mendieta and spoke to him during breaks.

Armstr ong denied that MacPherson looked at Alexander when he was in the courtroom, cal ling her one of the “most honourable” people he knows.

Experts say it's common for a Crown to show up at a retrial to se e how things turn out. But there are very clear rules of deportment for politica l lawyers, which apply even when they're off duty.
